Terms and Conditions of Gift Cards purchased in the online store or cafeteria platform

§1 DEFINITIONS
The terms capitalized in these Regulations shall have the following meaning:
- RISK Boutique or Brick-and-Mortar Store – Publisher’s retail outlet located in Warsaw, at ul. Szpitalna 6A.
- Digital Card – a Gift Card stored in digital form (numeric code), enabling the User to pay for Goods in the Online Store or RISK Boutique.
- Physical Card – a Gift Card stored on a physical medium, enabling the User to pay for Goods in the Online Store or RISK Boutique.
- Gift Card – a goods voucher stored on a physical medium or in digital form (numeric code) enabling the User to pay for Goods in the Online Store and Risk Boutique.
- Purchaser – a person who, in the Online Store, transfers funds to the Publisher in an amount equal to the value of the Gift Card, in exchange for which they receive a Gift Card from the Publisher.
- Privileged Entrepreneur – a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it is not of a professional nature for that person, resulting in particular from the subject of their business activity, made available on the basis of the provisions on the Central Register and Information on Economic Activity.
- Online Store – the Publisher's online store offering Goods, located at: https:// https://riskmadeinwarsaw.com/.
- Goods – items offered for sale in the RISK Boutique and in the Online Store.
- User – the Purchaser or the current holder of the Gift Card, presenting it for redemption in the Online Store.
- Publisher – RISK S.A. with its registered office in Warsaw at ul. Szpitalna 6A lok. 11 (00-031 Warsaw), entered in the register of entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, XII Economic Department of the National Court Register under KRS number 0000953550, NIP: 1132855615, REGON: 146129025, share capital: PLN 100,000.00 (fully paid up).
- Cafeteria Platform - an external website where Users can purchase or receive Gift Cards.
§2 GENERAL PROVISIONS
- Physical and Digital Gift Cards are available in the following denominations (in the section depending on where the Gift Card was purchased):
- At the RISK Brick-and-Mortar Store – a card of any denomination chosen by the Purchaser;
- At the RISK Online Store – PLN 250, PLN 500, PLN 1000;
- On the Cafeteria Platform – PLN 100, PLN 200, PLN 500, PLN 1000.
- The Publisher may introduce Gift Cards of other denominations without the need to amend these Regulations.
- A Gift Card (both Physical Card and Digital Card) purchased in the Online Store, Brick-and-Mortar Store, or Cafeteria Platform can only be redeemed in the Online Store or Brick-and-Mortar Store (Risk Boutique).
- The Publisher issues the Gift Card to the Purchaser exclusively through its purchase in the Online Store, Brick-and-Mortar Store, or Cafeteria Platform, depending on the type of Gift Card, in accordance with paragraph 3 above.
- The Publisher undertakes to provide the Purchaser with a Gift Card of a specified denomination and then to accept it for redemption, in accordance with paragraph 3 above.
- In exchange for the received Gift Card, the Purchaser undertakes to transfer funds to the Publisher in an amount equal to the nominal value of the given Gift Card. In the case of payment for the Gift Card in the Online Store, payment may be made using one of the payment methods available in the Online Store in accordance with the Regulations.
- Funds transferred to the Publisher by the Purchaser in accordance with paragraph 6 above become the full property of the Publisher at the moment the Gift Card is issued.
- The value of the Gift Card expressed in PLN (zloty) is equal to the amount contained therein.
- A Gift Card cannot be purchased using another Gift Card.
- The Gift Card is valid for a period of 6 months, for Gift Cards purchased in the Online Store or Brick-and-Mortar Store, and for a period of 12 months for Gift Cards purchased on the Cafeteria Platform, from the date of its issue to the Purchaser. Upon issuance of the Gift Card to the Purchaser, it is activated and the validity period of the Gift Card begins. The validity period of the Gift Card may be extended.
- Before redeeming the Gift Card, the User is obliged to read the content of these Regulations and to comply with its provisions.
- A Digital Card can be purchased in the Online Store, Brick-and-Mortar Store or Cafeteria Platform. A Physical Card can only be purchased in the RISK Boutique.
§3 USE OF THE GIFT CARD
- The Gift Card may only be used by natural persons with full legal capacity during the validity period of the Gift Card.
- The Publisher shall inform the User that the Gift Card:
- may be redeemed in accordance with § 2 para. 3 of the Regulations;
- is not exchangeable for cash;
- has an expiry date, after which it cannot be redeemed, with the expiry date described in § 2 para. 10 of the Regulations
- The User redeems the Gift Card by entering the numeric code of the Gift Card in the Online Store in the last step of the order process "Order Summary – checkout" in the "Gift Card code" field. The amount of funds deducted from the Gift Card will correspond to the price of the Goods purchased by the User from the Publisher.
- At the moment the User concludes a sales contract for Goods with the Publisher, by presenting the Gift Card for redemption, the sum of money accumulated on the Gift Card will be fully used to cover the price due to the Publisher for the sold Goods.
- In the event that the price of the Goods purchased by the User using the Gift Card is higher than the amount on the Gift Card, the User will be obliged to pay the difference using another form of payment, where in the Online Store, the User must use the payment methods indicated in the Online Store Regulations, and in the Brick-and-Mortar Store, cash or a debit or credit card.
- In the event that the price of the Goods purchased by the User using the Gift Card is lower than the total amount for the purchased Goods, the difference will remain on the Gift Card for use with any purchase within the validity period of the Gift Card specified in §2 para. 10 above.
- The Gift Card is a multi-use card. When using the Gift Card in the Online Store, the User is obliged to enter the numeric code located on the Gift Card. The provided code is a multi-use code until the amount contained on the Gift Card is exhausted or the Gift Card's validity period expires.
- The Publisher has the right to refuse to redeem the Gift Card in the event of:
- expiration of the Gift Card's validity period,
- objective lack of technical possibility to redeem the Gift Card, in particular due to:
- inability to connect to the Publisher's IT system due to a breakdown or other unforeseen technical event preventing purchases in the Online Store,
- damage to the Gift Card to an extent that makes it impossible to read the data recorded on the Gift Card.
- The Gift Card is not exchangeable for cash.
- The Publisher is not liable for Gift Cards that have been lost or damaged after being issued to the Purchaser without fault of the Publisher.
- In the event of loss, destruction, or theft of the Gift Card, the User has no claims against the Publisher.
- The Publisher is not responsible for the consequences of the inability to redeem the Gift Card resulting from circumstances for which the Publisher is not responsible, including, in particular, the loss of electronic or telephone connection with the Publisher's IT system.
- In the event that, despite the expiration of the Gift Card's validity period, the amount on the Gift Card remains unused, the User is not entitled to demand a refund of the funds transferred to the Publisher.
- In the event of (1) return of Goods purchased and paid for using a Gift Card in accordance with the provisions of the Online Store Regulations or the return policy introduced by the Publisher, (2) partial return of Goods from an order paid for using a Gift Card, or (3) withdrawal from a sales contract for Goods purchased and paid for in the Online Store using a Gift Card based on Article 27 of the Act of May 30, 2014, on consumer rights (i.e., Journal of Laws of 2019, item 134), the Publisher shall first refund to the same Gift Card the amount corresponding to the value used from the Gift Card to fulfill the order subject to the return. If the price of the purchased Goods exceeded the value of the Gift Card and the User paid this difference using another payment method, this amount will then be refunded by the Publisher – using the same payment method used to pay the price difference.
- If, at the time of return or withdrawal from the sales agreement for Goods, there are less than 30 days remaining until the Gift Card's expiration date, or if the Gift Card has already expired, after the refund is processed, the Gift Card will have its validity extended by 30 days - counted from the day the refund was made.
§4 COMPLAINTS
- All complaints related to Gift Cards will be handled by the Publisher in writing within 30 (thirty) days from the date of submission of the written complaint by the User.
- Complaints related to Gift Cards may also be submitted at the RISK Boutique, during the opening hours of the RISK Boutique provided on the Online Store's website.
§5 WITHDRAWAL FROM THE CONTRACT (RETURN OF THE GIFT CARD)
- The Purchaser, including the Privileged Entrepreneur, who purchased a Physical or Digital Card via the Online Store, may withdraw from the contract without giving a reason within 14 days of taking possession of it, by submitting a relevant statement of withdrawal to the Publisher, on the terms described in this paragraph.
- If the Gift Card has not been used in whole or in part by the day on which the withdrawal period expired, the Publisher will not refund to the Purchaser the amount equivalent to the value of the Gift Card that was redeemed.
- By withdrawing from the Gift Card agreement, the Purchaser undertakes not to use the Gift Card until it is returned. If, during the period between submitting the statement of withdrawal from the Gift Card agreement and returning the Gift Card to the Publisher, the Purchaser redeemed the Gift Card, the Publisher will be relieved of the obligation to refund to the Purchaser the amount paid for the issuance of the Gift Card to the extent that the Purchaser used the nominal value of the Gift Card.
- Given that in the case of a Digital Card, the subject of the contract is digital content as referred to in Article 2 point 5 of the Act of 30 May 2014 on consumer rights (i.e., Journal of Laws of 2019, item 134), the commencement of contract performance before the expiry of the statutory fourteen-day period for withdrawal must be preceded by the Purchaser's consent. In the event that the Purchaser gives consent to the commencement of performance of the Gift Card contract (i.e., providing the numeric code) before the expiry of the statutory fourteen-day period for withdrawal, the Purchaser will lose the right to withdraw from the contract, as referred to in Article 27 of the Act of 30 May 2014 on consumer rights (i.e., Journal of Laws of 2019, item 134), which is consistent with the norm contained in Article 38 point 13 of the aforementioned Act.
- These Regulations do not regulate the method of withdrawal from contracts concerning Gift Cards purchased on Cafeteria Platforms. In this regard, the provisions of the Cafeteria Platforms' Regulations are binding.
§6 FINAL PROVISIONS
- All matters not regulated in these Regulations shall be governed by the applicable provisions of law, including in particular the provisions of the Civil Code and the Act.
- The Gift Card is not an electronic payment instrument, is not an electronic money instrument, or a payment card.
- The issuance of a RISK Gift Card to the User does not constitute a sale subject to goods and services tax within the meaning of the relevant tax regulations. The User will receive a written receipt (Accounting Note) that is not a fiscal receipt or a VAT invoice.
- The Publisher reserves the right to amend the Regulations in the event of organizational or legal changes concerning the Publisher and its business activities, as well as changes in applicable laws pertaining to the Regulations and changes in the functionality of the Online Store pertaining to the Regulations. The amended terms of the Regulations will be made available on the website www.riskmadeinwarsaw.com.
- The Publisher reserves the right to suspend or terminate the issuance of Gift Cards at any time without giving a reason. The Publisher will inform Users of the Gift Card program of the suspension or termination with appropriate advance notice via the website https://www.riskmadeinwarsaw.com/.
- Users of Gift Cards purchased before the suspension or termination date of the program will be able to use them under the existing terms.
- The rules for purchasing Goods in the Online Store are regulated in the Online Store's regulations available at: https://www.riskmadeinwarsaw.com/pages/regulamin-sklepu-internetowego-risk.
- The rules for processing Users' personal data are set out in the Privacy Policy available on the website: https://www.riskmadeinwarsaw.com/pages/polityka-prywatnosci.
- The content of these Regulations is available in the RISK Online Store and at the Customer Service Department at: customercare@riskmadeinwarsaw.com.
The Regulations are effective from January 13, 2026.
